We purchased a home in Nebraska in March of 2019. At the time, we thought we were getting a great deal, but boy were we wrong. About 1 year after living here, there was water coming up from underneath a platform in the basement bathroom. Come to find out, the prior owner did all of the remodeling of the basement himself and didn’t pull any permits and had the vanity and shower draining into the floor drain. We haven’t had the money to fix it properly.

That was the first problem we discovered and have since tried selling our home and have had several investors come in to look at it. They have all said no permits were pulled and several things are not up to code. We are now looking at almost negative equity based on the couple of offers we have received from said investors.

I believe at the time of the basement plumbing issue I reached out to our realtor to see if there was anything we could go after the owner for and he told us there really wasn’t much we could do. I am working with my cell phone carrier now to try to get those text records.

I did a bit of research and it looks like Nebraska has a statute of limitations for this sort of thing of 5 years. My question is do you think it’s still feasible for us to go after the owner, our realtor, and the home inspector our realtor recommended?

TLDR; our house was not remodeled to code, is it too late to sue after 5 years of ownership
