Damage done post final inspection…

Question for you real estate experts. Let me give you the details and issue at hand:

-found a house coming for sale soon, saw it still occupied by seller.

-opened escrow, waived contingencies, allowed seller to find a place, empty his stuff out of the home, etc

-seller found a place and began moving out.

-we signed loan docs, but didn’t do the final walk through. We were set to record/close July 1.

-June 30 we do a final walk through and the owner is still moving out his stuff. 95% was out already with the understanding the home would be empty by the end of the day.

-July 1 he had a driveway/roll off dumpster removed from the property at 8am

-July 1 at 2pm the transfer recorded and I got the keys and became the new owner.

Here’s the issue: the dumpster guy hit the garage wall causing damage July 1 at 8am while the seller still controlled and owned the home.

I also found the rafters full of 4 trucks loads of junk + a few pieces of furniture left behind.

Seller admitted he hired a random with the dumpster (not licensed).

Should I request $$$ for the NEW damage the seller caused + the junk left behind? If he refuses should I sue him?

I bought the home as is, but I didn’t buy his junk or agree to any NEW damage…I feel a few thousand would be fair. I am not asking or wanting a crazy amount. Things happen, but it wasn’t my mistake.

My agent says “well you signed and own the house there’s not much you can do and you also got a great deal”.

This is in California if that matters.
