Our closing date is Monday and the sellers and their realtor are now being sued by the original buyers for breach of contract. Their agent told us that the buyers could not come up with the money by closing, requested an extension which they verbally granted, but upon receiving our offer they sent a letter to terminate the contract, which the buyers signed in exchange for their EM back. Or so we were told.

Now the buyers have officially filed a lawsuit against them, claiming that the extension was agreed to via email, therefore making it binding. They want the house plus damages. Obviously, we cannot close now. The sellers want us to terminate our contract. This is an extremely competitive area that has been a nightmare to get an offer accepted in and we are reluctant to walk away so easily. We want the house.

Needless to say, we’re furious. If they breach our contract, what (realistically) can we sue for? We were lied to and misled in a way that cost us the most important thing currently: opportunities to bid on other homes in a competitive market. Has anyone had experience successfully suing their seller for breach of contract? What was the outcome?

Also: fuuuuuuccccckkkkkkk
