Basically the neighbor above had AirBnB his unit, the tenant in there attaches a bidet, and removes it, it causes a huge leak, it floods 3 units directly below, 3 stories below. His insurance says they're not liable, they say the lanlord claimed the leak was from inside the plumbing.
We have a clear picture and 911 was there the leak was from the toilet plumbing where a bidet was claimed to have been installed by the airbnb tenant (mim 30 days stay in Los Angeles).
It caused about $50k repair after maxing out my own insurance. My insurance said I need to get a lawyer. The HOA says it's not their liability. Real estate lawyers lead me on and basically it's not worth it for them.
What can I do. What's the best approach. It's been nearly 9 months since the damage, it took 2-3 month to do the repair. I was short on the money front so I had to do a lot of the contractor job myself, but I hited and kept bills for all that was needed. We had estimates of about 100k in repair from Servpro. But I was afraid of hitting a roadblock like this and not being able to pay them, so i minimized the costs.
Can anyone help us what can be done really. The owner of the unit above doesn't answer to us, and the units below me have also hit the same roadblock. I thought of even doing a joint suit with them but one lawyer said with that even there is not enough money in it for them because their units were not as badly damaged as mine either.
