So this is a weird situation and I’m pretty sure it’s handled but I want some insight. Our home is for sale and under contract, closing next week. A member of our community we’ll call D is angry with us because a couple months ago he was voted to the board of the HOA. Due to his behavior as a board member as well as his harassment sexual and otherwise of other neighbors, we initiated a recall process and had him recalled from the board. All this to say: He does not like us. Today our realtor, R, who is helping us sell the house called us. R received a voicemail from a blocked number saying our homes irrigation is not up to county code and the caller “hoped the sellers disclosed this because I will certainly be letting the buyer know” and let the realtor know that he (R) “will be potentially legally liable for selling without disclosing this,” and on and on. Our realtor played the voicemail for us and it was without a doubt D who made the call.

His claims are ludicrous. Our home is 4 years old, we bought brand new construction in a new subdivision. The home was given a certificate of occupancy. But in the interest of due diligence we contacted the builder, as well as the city/county, and confirmed we have no issues.

While I have no doubt this will not affect our closing, there are some other homes in the neighborhood for sale. I want to warn the sellers that while this may be a personal vendetta, this happened to us and may happen to them as well. If such a voicemail was to cause a lost sale, what recourse can be taken if any? Location is Florida if that’s needed. Edit for spelling.
