We closed on a new build house 8 days ago. During the final walk through we were told that the house still needed to be cleaned and to ignore things like paint on the carpet as it was to be remedied with cleaning. One of the superintendent walking through with us pulled me away from my husband down the hall and told me to not get hung up on any of the cosmetic issues or small issues as he would address them after closing. He told me the walk through should last no more than 30 minutes so we could get on our way. We signed off on the items. I was hesitant to close as during the walk through I saw extensive paint and drywall damage to the carpet throughout the entire house. It looks like it snowed on the carpet. My realtor told us if we didn’t close on time we would be penalized $300 per day so we had no choice. Now that we have closed, the builder attempted to clean the carpet and the damage didnt improve, if anything it looks worse. The builder has agreed to replace the carpet, but this will take another month. I have a son with a life threatening medical condition and he cannot be exposed to ripped up carpet, so we are stuck in a rental until the issue is resolved. I wasn’t expected to be paying a mortgage and rent and things are getting tight. How can a builder get away with charging me $300 per day to delay a closing but they can financially screw me right now into a rental? Unfortunately the home is about 2/3rds carpet so it’s preventing us from getting much furniture or belongings moved in as well. Do I have any options at this point to try to get them to help cover the cost of a rental?
