So just a little backstory. My dad passed in 2019, leaving everything to my mom (79 years old currently).
She got 2-day dentures done in March ‘24 and she was very unhappy with the results. For that procedure, she took out a $40,000 loan (even though she has the cash to pay for it straight up).
She was refusing to pay this dentist. I said you are either going to have to pay them, or sue them, you can’t just do nothing. She was beginning to get afraid they would come after her and try and take her assets.
In her infinite wisdom, she went to a lawyer and did a “Quit-Claim Deed” and basically overrode her existing will, leaving the house to my only brother who lives 4 hours away. She thought she could hide the house in case she ended up in a court battle with the dentist.
She didn’t know that they look back, I believe, seven years to see if property has been transferred etc. they will find your money if you have.
Fast forward a month to April ‘24, my mom got very sick. She couldn’t walk across the room without gasping for air. By May she was in the hospital for over two weeks. Diagnosed with pneumonia and COPD.
Fast forward to June, here I am living at my mom’s house taking care of her. I’m 42, I have a house, family, step child, dog, job of my own. I have left all that for weeks to take care of her 24/7 so she didn’t have to go into a nursing home.
Now imagine my surprise when a letter comes in the mail from a title company saying “Quit-Claim Deed”. Basically transferring the house my dad bought, to my half brother.
So here she is now sick, hooked up to oxygen, me ripping my life apart to take care of her, And now the house I grew up in doesn’t even get split down the middle with my brother and I. (there is a whole lot of history there too)
My question is, for those of you who understand this type of thing, what do I do now? She says ohh, I’ll fix it, but she can’t drive. She doesn’t know what day it is. We have nurses coming in and out everyday. I don’t even know if SHE CAN fix it.
To my knowledge, my brother knows nothing about this. It states his mailing address as the property address here (hence me getting the letter at my moms). His signature is not on the document.
It has been described to me, that he will have to do a Quit-Claim Deed to give it back to my mom, therefore reverting it back to what the will states. Is this accurate?
What should my next steps be? If she were to die today, he would take the house. Sell it I’m sure, as he lives out of state, and considering our lack of relationship, probably keep all the money for himself.
What do I do?
