So I was looking for a home to live but also use as a STR because I travel a lot for work. Potentially looking to turn into a LTR or full time STR when I will probably move in a year or two. Due to this, I spoke with realtors and shared exactly what I was looking for and specified that I do not want a home with an HOA or similar because of certain restrictions on rentals. We found a house that seemed to fit all the parameters. Realtor and sellers said there was no HOA and it was all good. I even called the county to make sure I could use it as a rental and everything checked out. I bought the home. I go to apply for a STR permit and all of a sudden, the county says I need to wait 6 months. No problem - I’ll just wait as it is my primary residence. 3 months in, I let my grass get a little high (oops) and I receive a letter in the mail about a violation - not from the county. It is from a home rule city I apparently am part of by being in the neighborhood (essentially an HOA but my property taxes go to the “city” of 78 homes that “govern” themselves with ordinances). It’s actually SO much worse than an HOA and they are apparently so strict. I searched for a long time and finally found their ordinances that do not allow rentals at all. Sooo I’m very upset that realtors didn’t mention this. I had no idea that even existed (it’s in KY and I’m from VA where those don’t exist). I specifically asked about no HOA or anything that was similar and I got exactly that - or worse. I could not find anything about that in my research before buying the home (which was extensive). I feel lied to because realtors, sellers, and the county should have known this and no one disclosed this information???? In VA, it is required that we see ordinances of an HOA or whatnot in a neighborhood before buying so how was I never even told about these home rule cities, let alone given notice about their ordinances??? I have no idea what to do now. I do not want this to be a permanent home (and cannot because of work) and I will lose tens of thousands of dollars by selling now.
