I was under contract for a house, and my financing didn’t go through due to the property itself. I have a financial contingency on the property, and mentioned it to the sellers agent. However, the seller is not trying to sign the mutual release. We have only 2 days left on the contract and I need the seller to sign the mutual release so I can get my EMD back.
Secondly, the sellers agent already went ahead and relisted the property while we are still under contract and no mutual release has been signed yet.
What are my options here? I been working hard to get my EMD back because contractually I believe it’s my right since the financing did not go through.
