My house has been on the market for 4 months. We had a showing at the very beginning that we received a cash offer but never executed as buyer’s agent quickly pulled the contract. 4 months later unbeknownst to us, we were contacted by the children of that buyer where they wanted to make a cash offer unrepresented. We unofficially accepted their lower offer bc they were unrepresented. We talked to our agent and they agreed to reduce the commission base on buyer being unrepresented. We are still keeping our agent whole. In discussion with these “new” buyers we asked for proof of funds before drafting a contract. They indicated that they have their house pending and will be closing in 2 weeks. Doing our due diligence, we asked for a copy of said contract. This is when we found out they are the same buyers from 4 months ago. Will I be liable to pay their old agent if we close on my house and their old agent finds out? Should I CYA and ask buyer if they ever signed a BRA with their old agent? Looking for advice before raising this to my agent
