The title company made no distinction of tenancy on our title. We are now filed at tenants in common for the last 6 years and have been paying extra property taxes to go with it. The title company has admitted their fault and offered to correct the error for free. However the other party on the deed is 76 years old and stubbornly mistrusting of a quit claim deed. Would a corrective deed suffice for this level of error ? Do I need to hire a real estate attorney to insure that the new title is done correctly as the title company has already proven negligence.
